2. What data we process and where it comes from
We process the data that you provide to us by email, telephone, WhatsApp, in person or through the contact form:
- Identification and contact details: first name and surname, telephone number and email address.
- Content of your enquiry: the service you are interested in, the address or characteristics of the property and any other information you decide to share with us.
- If you contract a service: the data needed to provide and invoice it (for example, property details, cadastral reference, technical documentation or policy details).
This website does not collect browsing data for analytics or advertising purposes.
3. Purposes
- Responding to enquiries and requests for information or quotations.
- Providing the services you contract: technical projects, energy performance certificates, habitability certificates, renovations and insurance.
- Carrying out the administrative formalities required before public bodies where the service so requires.
- Invoicing and complying with legal, tax and accounting obligations.
- Handling the exercise of your rights and, where applicable, defending ourselves against claims.
We do not send commercial communications without your prior consent and we do not create profiles through automated decision-making.
4. Legal basis
- Enquiries and quotations: taking steps at your request prior to entering into a contract (art. 6(1)(b) GDPR).
- Provision of the contracted service: performance of a contract (art. 6(1)(b) GDPR).
- Invoicing, tax obligations and formalities before public authorities: compliance with legal obligations (art. 6(1)(c) GDPR).
- Website security and defence against claims: legitimate interests (art. 6(1)(f) GDPR).
The checkbox on the form confirms that you have read this information; it is not consent for additional purposes.
5. How the contact form works
The form on this website does not send your data to any server: when you press “Send”, your browser opens your email application (or WhatsApp, if you choose that option) with the message ready. The data only reaches us if you send that message from your application.
6. Retention periods
- Enquiries that do not lead to a contractual relationship: up to 24 months from the last relevant interaction, unless you request deletion earlier.
- Clients and services provided: for the duration of the relationship and, afterwards, blocked for the statutory limitation periods (tax, accounting, civil and professional liability).
- Communications concerning the exercise of rights: for the time necessary to demonstrate that they have been dealt with.
7. Recipients and processors
We do not sell personal data or disclose it to third parties for their own purposes. The following may have access to it, or receive it where necessary:
- Providers that process data on our behalf under a data processing agreement: web hosting, email and internal client management.
- WhatsApp Ireland Ltd., if you contact us via WhatsApp.
- Insurers, when you request or take out insurance and to the extent necessary to process it.
- Public authorities, where the service so requires (for example, town councils for licences and notifications, the ICAEN register of energy performance certificates or the Catalan Housing Agency for habitability certificates), or where required by law.
8. International transfers
We do not intentionally carry out international transfers of data. If any provider processes data outside the European Economic Area, it will do so on the basis of an adequacy decision or appropriate safeguards, such as the European Commission’s standard contractual clauses.
9. Your rights
You may at any time exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability, and withdraw any consent you have given, without affecting the processing carried out before withdrawal.
How to do so: write to info@nexthome.cat or to the address given above, stating which right you wish to exercise. We will only ask you for the minimum information necessary to confirm your identity. We will reply within one month, which may be extended by a further two months in complex cases (we would notify you within the first month).
If you consider that we have not properly dealt with your rights, you may lodge a complaint with the Spanish Data Protection Agency (AEPD) (www.aepd.es).
10. Security
We apply technical and organisational measures proportionate to the risk in order to protect the confidentiality, integrity and availability of the data: access control, restricted permissions, encrypted communications (HTTPS) and backups. No system is infallible, which is why we review these measures periodically.
11. Minors
Our services are not aimed at children under 14. Please do not send us data relating to minors without the authorisation of the person who holds legal representation of them.
12. Changes to this policy
We may update this policy when our processing activities or the applicable legislation change. The date above identifies the version in force. See also the cookie policy and the legal notice.
